TSK Liability Release & Assumption of Risk

Updated: April 2026 By visiting Third Space for Kids (“TSK”), the accompanying parent, caregiver or responsible adult (“Parent or Caregiver”) of a minor Guest agrees to the following terms in this TSK Liability Release & Assumption of Risk (hereinafter “Waiver” or “Parental Waiver”): There must be at least one Parent or Caregiver accompanying and responsible for any child or any group of children who enter TSK with them for the duration while such child or children are on TSK premises.

Scope of Release

This release applies to all activities, services, and use of facilities provided by TSK. It also extends to TSK’s staff, owners, agents, and any third-party provider of toys, equipment, or services. The scope of this release covers the Terms of Use policies for Drop-in guests and Members. When signing this waiver, you agree to the Terms of Use and assume risk when in noncompliance with the Terms of Use when using TSK services.

Understanding the Risks

As the Parent or Caregiver, I acknowledge that: I am responsible for supervising the minor Guest and ensuring they only engage with toys and activities that are appropriate for their age and abilities. Risks may include, but are not limited to: misuse of toys or equipment, ingestion of small parts, or injury from inappropriate play. While TSK may inspect and clean toys, it does not guarantee their safety, condition, or suitability for any specific child. TSK provides entertainment services and does not make any claims or warranties regarding the safety, cleanliness, or appropriateness of toys or activities.

Assumption of Risk

I understand and accept that participation in TSK activities involve both known and unknown risks. I voluntarily assume full responsibility for these risks on behalf of myself and the minor Guest.

Release of Liability

To the fullest extent permitted by law, I release and discharge TSK, its officers, employees, agents, contractors, volunteers, and affiliates (“Released Parties”) from any and all claims, demands, damages, liabilities, costs, and causes of action arising out of or related to my child’s participation at TSK, including injury, illness, or property damage, except where prohibited by law.

Indemnification

I agree to defend, indemnify, and hold harmless the Released Parties from any claims or demands brought by or on behalf of my child or third parties related to my child’s participation, including reasonable attorneys’ fees and costs, except to the extent caused by the gross negligence or willful misconduct of the Released Parties.

Responsibility & Supervision

I accept full responsibility for myself and the minor Guest(s). I agree to remain on the premises while my child is present and understand that leaving the premises is not permitted. All Parent or Caregiver must be present at TSK while the minor Guest is on TSK premises. At least one adult that assumes responsibility under these terms will remain on the premises at all times with the minor Guest(s).

Dispute Resolution & Agreement Terms

By visiting TSK, the Parent or Caregiver accompanying a minor Guest agrees to the following:

Resolving Disputes

In the event of a disagreement between myself and TSK, I agree to first make a good faith effort to resolve the issue through mediation. If mediation does not resolve the matter, I agree that any dispute, controversy, or claim will be submitted to binding arbitration under the rules of the American Arbitration Association. All mediation or arbitration will take place in Montgomery County, Maryland, and will be governed by the laws of the State of Maryland, regardless of where the issue originated.

Duration of Agreement

This agreement applies to all current and future visits to TSK by myself and the minor Guest, unless canceled in writing or otherwise expired under applicable state law. For members (persons with a Weekly or Monthly Membership), this liability release will be kept on file with your membership.

Acknowledgment & Acceptance

I confirm that I have read and understood this Liability Release and Agreement. I understand that it is legally binding on me, the minor Guest, and our respective family members, heirs, executors, and representatives. If any part of this agreement is found to be invalid by a court, the remaining provisions will continue to be fully enforceable.

Drop-in Guests and Members Terms of Use

Check-In & Admission for Drop-in Guests

All drop-in guests must check in at the front desk upon arrival and check out when leaving. Participation in TSK activities requires an hourly fee, which will be charged for each hour, with a 15 minute grace period before being charged full price for any additional hour. Admission is required for all children 6 months or older due to max capacity limitations. TSK provides services primarily for toddlers through elementary school. We provide a space for infant siblings for the convenience of the family. Due to capacity limitations by law, we must charge admission for each little person. TSK reserves the right to not invite any guests back to TSK who violate security and safety protocols. Our priority is everyone’s safety.

Check-In & Admission for Members

Members agree to check in and check out of TSK on the Third Space for Kids app (available for iPhone or Android) on their mobile phones. To enter TSK premises, please use your Third Space for Kids app to scan into our entry system. You and each of the children added to your account have his/her own unique bar code. Please scan each bar code when arriving. Admission is required for all children 6 months or older due to max capacity limitations. TSK provides services primarily for toddlers through elementary school. We provide a space for infant siblings for the convenience of the family. Due to capacity limitations by law, we must charge admission for each little person. An adult will only be permitted into TSK accompanied by at least one child. When you choose a membership level, you agree to follow the rules and guidelines that come with that level. All members agree that members must be children and adults from the same family. You also agree to use TSK facilities and services only in ways that fit your membership type. If these guidelines aren’t followed, your access or membership may be limited, suspended, or canceled. TSK reserves the right to not invite any guests back to TSK who violate security and safety protocols. Our priority is everyone’s safety.

Purchase of Memberships

Each child in your family has their own membership. You agree to sign your name to each Terms of Use and Waiver that will appear for each child membership. By purchasing a membership, you, as the parent, accept the terms to all Terms of Use and Waiver. When purchasing memberships, please follow the instructions online. We do this so that we can offer memberships by the number of children in your family rather than charging a flat rate. We understand families are in all sizes! Under this system, you can sign up each child for different events that focus on particular age groups.

Parental/Adult Supervision

Parents or legal guardians (“Supervising Adult”) must remain on the TSK premises at all times while their child is participating in any activity, program, or event. The Supervising Adult is fully responsible for the child’s safety, behavior, and well-being during the visit. There must be at least one adult responsible for each child or for each group of children who arrives with the adult. You, as the parent, agree that you are liable for any adult that you designate as the Supervising Adult of your child/children who will supervise your child/children on TSK premises. Any adult guest must be accompanied by at least one child to be admitted. Failure to remain on-site may result in the child’s participation being terminated and future access restricted.
  • As we are a play center (not babysitting or a daycare), please immerse in activities with your child/children ages preschool and younger to keep them safe.
  • The Supervising Adult accepts all Terms and Conditions and Waivers that apply to you.
  • The Supervising Adult must be reachable and available to staff at all times.
  • Children may not be left unattended under any circumstances.
  • Staff members are not responsible for supervising or monitoring any particular child/children.

TSK Conduct & Wellness Guidelines

We’re committed to creating a safe, respectful, and enjoyable space for all families. We make every effort to limit activities with parts that are not a choking hazard and are age-appropriate for the space. However, please keep an eye on your child. Our staff are present to provide an overall safe and engaging environment for play and learning, and are not present to provide care for a specific child. Please help us maintain a positive environment by following these guidelines during your visit.

Capacity & Safety

To comply with fire safety regulations and to ensure a comfortable environment, TSK will limit the number of guests (children and adults). Space is limited according to safety code restrictions. Please make room for other children to enjoy TSK unless your child plans to actively engage in a TSK activity. We appreciate your cooperation in helping us maintain a safe space for all. For the safety of all, the door to TSK will be locked from the outside and will be accessed by members through our electronic system. Drop-in guests will be permitted to enter by our staff.

Clean Play Environment

Shoes are not allowed past the entry area. Please wear socks or shoes that have not been worn outdoors, to help keep the space clean. Please sanitize your hands before engaging in play. Strollers may be folded and stored in the storage room for your convenience. Restrooms are immediately outside the door of the suite. TSK reserves the right to suspend visitor privileges for any violation of these policies. Thank you for helping us create a safe and welcoming space for all families!

Respectful Behavior

TSK is a shared space. Please encourage children to play gently and respectfully. Children engaging in rough, disruptive, or unsafe behavior may be asked to leave. Children with ongoing behavioral challenges may be asked not to participate in certain classes, programs, or any services. TSK is meant for children to learn how to interact with each other in a respectful and productive manner. We are a welcoming environment to all. We encourage children to share activities boxes. To keep the space tidy and welcoming, please take out only one or two toys at a time, and clean up after use.

Health & Illness

If your child is feeling unwell, please keep them home until they’ve been symptom-free for at least 24 hours. For guidance on contagious illnesses, visit the CDC Parent Portal or speak with our front desk team. TSK reserves the right to send a child home if they appear sick.

Personal Items

TSK is not responsible for any lost, stolen, or damaged personal belongings. Items left behind and turned into staff will be held for 10 business days before being donated or discarded.

No Smoking

Smoking is not permitted anywhere on the TSK premises.

Security Camera Surveillance

For the safety and security of all guests, staff, and the premises, TSK uses Ring security cameras throughout our facility. The following applies to our surveillance practices:

Camera Locations

Security cameras are installed in common areas including, but not limited to:
  • Building entrances and exits
  • Play areas and activity zones
  • Reception and check-in areas
  • Kitchen and storage areas
Cameras are NOT installed in restrooms where guests have a reasonable expectation of privacy. Please note that TSK does not operate the restrooms at the 7801 Norfolk Avenue building. Common areas and areas that are not leased to Third Space for Kids, LLC are the responsibility of the building owner, 7801 Norfolk Avenue, LLC, except to the extent required by law.

Purpose of Surveillance

  • To ensure the safety and security of children, guests, and staff
  • To prevent theft, vandalism, or unauthorized access
  • To investigate incidents or accidents if they occur
  • To comply with applicable legal requirements

Retention of Footage

Video footage is typically retained in accordance with the use of the subscription with Ring. Access to footage is restricted to authorized management personnel only.

Signage & Notice

Security camera notices are posted at all facility entrances. By entering our premises, guests acknowledge and consent to being recorded in monitored areas for purpose herein.

How We Use Your Information

We use the personal information we collect for the following purposes:
  • To check in guests, process registrations, and manage memberships
  • To contact you regarding your reservation, booking, or membership
  • To process payments and maintain financial records
  • To respond to inquiries, feedback, or complaints

Data Retention

When your information is no longer needed, we will securely delete from our active member list. We will retain your personal information in the ABC Glofox system in order to provide promotional discounts and communications about our ongoing services.
